1. About BY FRIDMAN Studio
BY FRIDMAN Studio is operated by MADAME & MONSIEUR AS, a Norwegian limited company registered in the Norwegian Register of Business Enterprises (Foretaksregisteret), organisation number 813 206 382, VAT number NO 813 206 382 MVA.
Customer service and showroom address: Varnaveien 35, 1526 Moss, Norway. Email: post@byfridman.no. Telephone: +47 990 18 839.
These Terms & Conditions apply to consumer purchases made through byfridmanstudio.com. By placing an order, you agree to these Terms together with the applicable product information, Shipping Policy, Returns & Refunds Policy and Privacy Policy.
2. Governing framework and mandatory consumer rights
These Terms are governed by Norwegian law. If you are a consumer residing in another country, nothing in these Terms removes or restricts any mandatory consumer right that applies to you and cannot legally be waived by contract.
If any provision in these Terms conflicts with mandatory consumer law, the mandatory rule will apply to the extent of the conflict and the remaining Terms will continue to apply.
3. Our made-to-measure model
Except for non-sized accessories such as silk scarves and ties, BY FRIDMAN garments are not produced as standard-size stock. Each garment is individually produced after an order is placed, using the body measurements and specifications confirmed by the customer.
These garments are personalised made-to-measure products. The customer's measurements are used as inputs to our own pattern blocks, construction methods and design-specific fit allowances. A finished garment is therefore not intended to measure exactly the same as the customer's body measurements.
4. Measurements, ease and technical fit decisions
Body measurements require wearing ease. Our patterns therefore include design-specific allowances for movement, layering, construction and the intended silhouette. Depending on the design, the finished garment can be larger than the customer's body measurement by more than one centimetre.
In addition to the standard ease built into our patterns, BY FRIDMAN may make small technical adjustments to the calculated garment dimensions where we reasonably believe this will improve comfort, movement, balance or alterability. This can include adding approximately 1 cm of additional ease or length where appropriate.
Where there is reasonable doubt, we may choose a slightly more generous fit rather than produce a garment that is too small or too short. A garment can normally be reduced or shortened by a tailor, while increasing width or length may be limited or impossible depending on seam allowance, construction and fabric.
These technical decisions are part of the made-to-measure process and are not, by themselves, evidence that the garment is defective.
5. Customer responsibility for measurements
The customer must review all body measurements carefully before placing the order and must correct any measurement that is inaccurate.
If BY FRIDMAN provides an AI-assisted tool, calculator or recommendation that suggests measurements based on answers, images or other information, the suggested measurements are guidance only and are not a guarantee of accuracy. The customer must review and expressly confirm the measurements before ordering.
Where a garment is produced in accordance with measurements and specifications confirmed by the customer, an incorrect customer-confirmed measurement is not a manufacturing defect. This does not exclude liability where a non-conformity is caused by BY FRIDMAN, or where mandatory law provides otherwise.
For best results, measurements should be taken in accordance with our measurement instructions and with relevant undergarments, shapewear and intended footwear where these affect fit or garment length.
6. Optional notes and additional measurements
Each product page may include a note field where the customer can provide additional measurements, fit information or special requests. This field is optional unless the product page states otherwise.
Additional notes do not automatically become accepted design changes. If a request would materially alter the design, construction, price or production time, BY FRIDMAN may contact the customer for confirmation before production.
7. Order review, acceptance and changes
Placing an order constitutes an offer to purchase. An automated order confirmation confirms receipt of the order. BY FRIDMAN may perform payment, fraud, measurement, material or production checks before final production begins.
Because personalised garments are made specifically to the customer's confirmed measurements and specifications, a change-of-mind cancellation or withdrawal is not available where the applicable law recognises the personalised-goods exception. For Norwegian/EEA consumers, that exception can apply from the time the contract is concluded for goods to be made to the consumer's specifications, even if physical production has not yet begun. BY FRIDMAN may nevertheless accept a requested change or cancellation at its discretion if production, fabric commitments and other costs allow.
If we identify an obvious measurement anomaly before production, we may contact the customer for clarification. The absence of such contact does not transfer the customer's responsibility to review and confirm their measurements.
The customer must also verify the measurement unit used (for example centimetres versus inches) and remains responsible for changes in body measurements after the order is confirmed, including weight change, pregnancy or other changes that affect fit. Such post-order body changes are not manufacturing defects.
8. Fabric and component availability
Our garments are produced after order and certain fabrics, trims or components are supplied by third parties. Availability can change without notice.
If a selected fabric or material becomes unavailable after an order is placed and we cannot fulfil the order as agreed, we will contact the customer. We will not make a materially different substitution without the customer's approval. If no acceptable solution is agreed, the affected item will be cancelled and refunded in accordance with applicable law.
9. Handmade production and natural variation
Each garment is individually cut, sewn and finished by people. Minor variations that are inherent to hand-finishing, natural fibres, weave, texture, colour lot or fabric behaviour may occur and do not constitute a defect where the product remains materially consistent with the agreed design and description.
Colours may also appear slightly different depending on screen settings, lighting and the characteristics of the fabric.
10. Production times and delays
Production and delivery estimates shown on the website are good-faith estimates rather than guaranteed dates unless expressly stated otherwise.
BY FRIDMAN is a slow-fashion, made-to-measure business. Every garment is individually cut, sewn, finished and quality-checked by people rather than mass-produced. Fabric and trim deliveries, specialist production stages, quality control, customs procedures and international transport can occasionally add a small number of days to the estimated timeline.
We will use reasonable efforts to meet the estimated timeframe and will communicate material delays when reasonably possible. Delays caused by events outside our reasonable control, including natural disasters, war, governmental restrictions, major transport disruption, customs closures or significant supplier interruption, may extend the timeline. This clause does not remove any mandatory consumer remedy that applies if a delay becomes legally significant.
11. Shipping, delivery and risk
Orders may be produced, quality controlled, packed and dispatched through specialised international production and logistics partners acting on behalf of BY FRIDMAN.
Where BY FRIDMAN arranges the carrier, risk of accidental loss or damage remains with BY FRIDMAN until the customer, or a third party appointed by the customer other than the carrier, physically receives the goods, except where mandatory law provides otherwise.
The customer is responsible for providing a complete and accurate delivery address and for cooperating with reasonable delivery requirements. Additional costs caused by an incorrect address, repeated failed delivery attempts or an unjustified refusal to accept delivery may be charged where permitted by law.
12. Duties, taxes and DDP
For destinations where checkout states that duties and taxes are included, the shipment is intended to be sent on a Delivered Duty Paid (DDP) basis and applicable import duties and import taxes are included in the amount charged at checkout.
If a carrier unexpectedly requests duties or import taxes on an order confirmed as DDP, the customer should contact BY FRIDMAN before paying the charge where reasonably possible. Any destination where DDP cannot be provided should be disclosed before the order is accepted.
13. Personalised garments and change-of-mind returns
Personalised made-to-measure garments are produced specifically to the customer's confirmed measurements and individual specifications. Where permitted by applicable law, they are final sale and are not eligible for change-of-mind cancellation, return, exchange or refund because the customer changes their mind, no longer wants the product, prefers another style, has a change of plans, or simply does not like how the chosen design looks on them.
Under Norwegian law, the statutory right of withdrawal does not apply to goods made to the consumer's specifications or given a clearly personal character. This final-sale rule does not affect rights relating to manufacturing defects, non-conforming goods or other rights that cannot legally be excluded.
14. Fit expectations and local tailoring
Made-to-measure is designed to create a personalised fit, but remote made-to-measure is not the same process as multiple in-person fittings with a local tailor. Posture, body asymmetry, preferred ease, undergarments, footwear and personal styling preferences can affect how the final garment feels and sits on the body.
A minor local adjustment can therefore be appropriate even where a garment has been correctly produced. If a customer wishes to refine sleeve length, trouser length, waist suppression, hem length or another personal fit preference, we recommend using a qualified local tailor.
Unless a separate BY FRIDMAN Fit Adjustment Promise applies, alterations requested purely for personal preference are the customer's responsibility. If the customer believes there is a manufacturing defect or material deviation from the confirmed order, BY FRIDMAN should be contacted before substantial third-party alterations are carried out.
15. Manufacturing defects and non-conforming goods
A manufacturing defect or non-conformity can include a garment that materially differs from the agreed design, fabric, colour, confirmed specifications or the measurements that BY FRIDMAN was required to use, subject to reasonable tailoring ease and production tolerances.
If a customer believes a product is defective or incorrectly manufactured, they should contact us promptly with the order number, photographs, a description of the issue and, where relevant, measurements of the garment.
Where a defect exists, remedies will be provided in accordance with applicable mandatory consumer law. Depending on the circumstances, this can include repair, alteration, replacement, price reduction or refund. Nothing in these Terms limits statutory rights relating to defective or non-conforming goods.
For Norwegian consumers, statutory complaint rights apply in accordance with the Norwegian Consumer Purchases Act. A complaint must be made within a reasonable time after the defect was or should have been discovered; the statutory long-stop period is normally two years from delivery, or five years where the item or relevant part is intended by normal use to last substantially longer. Rights in other markets are preserved where mandatory law provides greater protection.
16. Security seals, tags and condition of garments
Personalised garments are final sale for change of mind where permitted by law regardless of the security seal. In addition, any discretionary goodwill return, store credit or fit-support arrangement offered by BY FRIDMAN may require all security seals and tags to remain intact.
For any discretionary goodwill return, store credit or fit-support arrangement, the garment must retain all BY FRIDMAN security seals and tags and must not have been used as clothing. Only a brief, careful indoor fitting is permitted. The garment must not have been worn outside, washed, dry-cleaned, perfumed or otherwise scented, damaged or altered.
A broken security seal, removed tag or evidence of wear may make a discretionary return, exchange, credit or fit-support benefit unavailable. However, a seal or tag condition does not remove mandatory statutory rights where the garment is defective or non-conforming.
If the customer believes there may be a manufacturing defect, they should contact BY FRIDMAN before removing the security seal or arranging alterations where reasonably possible. Failure to keep the seal intact may affect discretionary benefits, but it does not extinguish a mandatory statutory defect claim.
17. Care and customer-caused damage
Customers must follow the care instructions supplied with the garment. Delicate fabrics may be vulnerable to jewellery, rough furniture, sharp edges, friction, improper washing or unsuitable cleaning methods.
Damage caused after delivery by misuse, improper care, accident, snagging, unauthorised alteration or normal wear and tear is not a manufacturing defect.
18. Non-personalised accessories
Non-personalised accessories, including standard silk scarves and ties, are treated separately from personalised made-to-measure garments. Where Norwegian or EEA distance-selling withdrawal rights apply, eligible non-personalised accessories may be returned within the statutory withdrawal period in accordance with our Returns & Refunds Policy.
If an accessory has been personalised, monogrammed or otherwise made to the customer's individual specifications, a statutory exception may apply where permitted by law.
19. Intellectual property
All BY FRIDMAN designs, photographs, text, graphics, trademarks, original patterns, artwork and other creative materials are owned by or licensed to BY FRIDMAN. Purchase of a product does not transfer any intellectual property rights in the design or content.
No website content or design may be reproduced, adapted, distributed or used commercially without prior written permission.
20. Limitation of liability
To the maximum extent permitted by law, BY FRIDMAN is not responsible for indirect or consequential losses that were not reasonably foreseeable when the contract was made.
Nothing in these Terms excludes or limits liability that cannot legally be excluded, including mandatory consumer remedies for defective or non-conforming goods, fraud, or other liability that applicable law requires us to retain.
21. Force majeure and events outside reasonable control
BY FRIDMAN will not be treated as having guaranteed an exact production or delivery date where performance is delayed by an event genuinely outside our reasonable control. We will take reasonable steps to minimise the effect of such an event and communicate material disruption.
If performance becomes impossible or a delay gives the customer a mandatory right to cancel, obtain a refund or exercise another remedy, those rights remain unaffected.
22. Changes to these Terms
We may update these Terms from time to time. The Terms applicable to an order are those made available to the customer when the order is placed, except where a later change is required by law.
23. Contact
